İşbu Mesafeli Satış Sözleşmesi ("Sözleşme"), melonscript.com.tr internet sitesi üzerinden elektronik ortamda gerçekleştirilen dijital ürün ve hizmet satışlarına ilişkin tarafların hak ve yükümlülüklerini düzenlemektedir.
1. TARAFLAR

(Bundan sonra "Satıcı" olarak anılacaktır.)
Alıcı:
Site üzerinden üyelik oluşturan veya sipariş veren gerçek ya da tüzel kişi.
(Bundan sonra "Alıcı" olarak anılacaktır.)
2. SÖZLEŞMENİN KONUSU
İşbu sözleşmenin konusu, Alıcı'nın Satıcı'ya ait internet sitesi üzerinden elektronik ortamda sipariş verdiği dijital ürün ve hizmetlerin satışı, teslimi ve kullanım şartlarının belirlenmesidir.
3. SATIŞA KONU ÜRÜN VE HİZMETLER
Satıcı tarafından sunulan ürün ve hizmetler aşağıdakilerle sınırlı olmamak üzere şunlardır:
- MTA (Multi Theft Auto) Scriptleri
- Discord Bots
- Özel Yazılım Hizmetleri
- Web Site Hizmetleri
- Dijital Lisanslar
- Yazılım Paketleri
- Sunucu Entegrasyonları
- Teknik Destek Hizmetleri
Satın alınan ürünün türü, açıklaması, fiyatı ve özellikleri sipariş sırasında Alıcı'ya gösterilir.
4. SİPARİŞ VE ÖDEME
4.1. Alıcı, sipariş oluştururken verdiği bilgilerin doğru ve eksiksiz olduğunu kabul eder.
4.2. Sipariş, ödeme işleminin başarılı şekilde tamamlanmasıyla kesinleşir.
4.3. Satıcı, güvenlik gerekçesiyle gerekli gördüğü durumlarda ek doğrulama talep edebilir.
4.4. Ödeme kuruluşlarından veya bankalardan kaynaklanan teknik aksaklıklardan Satıcı sorumlu değildir.
5. TESLİMAT
5.1. Satılan ürünler dijital ürün veya dijital hizmet niteliğindedir.
5.2. Teslimat aşağıdaki yöntemlerden biri ile gerçekleştirilebilir:
- Kullanıcı paneli üzerinden erişim
- İndirme bağlantısı
- Discord üzerinden teslimat
- E-posta yoluyla teslimat
- Lisans anahtarı veya aktivasyon kodu gönderimi
5.3. Ödeme onaylandıktan sonra ürün, ürün açıklamasında belirtilen süre içerisinde teslim edilir.
5.4. Mücbir sebepler veya teknik sorunlar nedeniyle oluşabilecek gecikmelerde kullanıcı bilgilendirilir.
6. CAYMA HAKKI
6.1. Satışı yapılan ürünlerin büyük bölümü dijital içerik ve yazılım niteliğindedir.
6.2. 6502 Sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği uyarınca; Elektronik ortamda anında ifa edilen dijital içerikler ve yazılımlarda, tüketicinin açık onayı ile ifaya başlanması halinde cayma hakkı kullanılamaz.
6.3. Alıcı, satın alma işlemini tamamlayarak dijital ürünün teslimine başlanmasını kabul ettiğini ve bu nedenle cayma hakkını kaybedebileceğini kabul eder.
7. İADE VE İPTAL KOŞULLARI
7.1. Teslim edilmiş dijital ürünlerde kural olarak ücret iadesi yapılmaz.
7.2. Aşağıdaki durumlarda iade talebi değerlendirilebilir:
- Ürünün teslim edilememesi
- Satıcı kaynaklı teknik hata bulunması
- Ürünün açıklamada belirtilen özellikleri taşımaması
7.3. Kullanıcının sistem yapılandırması, bilgi eksikliği, üçüncü taraf yazılımlar veya sunucu ayarlarından kaynaklanan sorunlar iade sebebi olarak kabul edilmez.
7.4. İade talepleri destek@melonscript.com.tr adresi üzerinden iletilmelidir.
8. FİKRİ MÜLKİYET HAKLARI
8.1. Satılan tüm yazılımlar, scriptler, botlar, tasarımlar ve içerikler üzerindeki fikri mülkiyet hakları Melon Script'e aittir.
8.2. Alıcı; ürünü yeniden satamaz, kaynak kodunu paylaşamaz, kopyalayamaz, lisanssız dağıtamaz, tersine mühendislik yapamaz.
8.3. Bu hükümlerin ihlali halinde Satıcı'nın hukuki ve cezai yollara başvurma hakkı saklıdır.
9. SORUMLULUĞUN SINIRLANDIRILMASI
9.1. Satıcı, ürünlerin kullanımından doğabilecek dolaylı zararlar, veri kayıpları veya gelir kayıplarından sorumlu değildir.
9.2. MTA güncellemeleri, Discord API değişiklikleri, sunucu yapılandırmaları veya üçüncü taraf yazılımlardan kaynaklanan uyumsuzluklardan Satıcı sorumlu tutulamaz.
9.3. Satıcı, hizmetlerin kesintisiz veya hatasız çalışacağını garanti etmez.
10. KİŞİSEL VERİLERİN KORUNMASI
Alıcı'ya ait kişisel veriler, 6698 Sayılı Kişisel Verilerin Korunması Kanunu (KVKK) kapsamında işlenmekte ve korunmaktadır. Detaylı bilgi için KVKK Aydınlatma Metni ve Gizlilik Politikası incelenebilir.
11. MÜCBİR SEBEPLER
Doğal afetler, savaş, terör olayları, internet altyapı sorunları, elektrik kesintileri, siber saldırılar ve benzeri durumlar mücbir sebep olarak değerlendirilir. Mücbir sebep süresince taraflar yükümlülüklerini yerine getirememekten sorumlu tutulamaz.
12. UYUŞMAZLIKLARIN ÇÖZÜMÜ
İşbu sözleşmenin uygulanmasında Türkiye Cumhuriyeti Kanunları geçerlidir. Uyuşmazlıkların çözümünde, Ticaret Bakanlığı tarafından ilan edilen parasal sınırlar dahilinde Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri yetkilidir.
13. YÜRÜRLÜK
Alıcı, internet sitesi üzerinden sipariş vererek işbu sözleşmenin tamamını okuduğunu, anladığını ve kabul ettiğini beyan eder. İşbu sözleşme elektronik ortamda onaylandığı tarihte yürürlüğe girer.

This Distance Sales Agreement ("Agreement") regulates the rights and obligations of the parties regarding the digital product and service sales performed electronically via the melonscript.com.tr website.
1. PARTIES

(Hereinafter referred to as the "Seller".)
Buyer:
The real or legal person who creates a membership or places an order on the Site.
(Hereinafter referred to as the "Buyer".)
2. SUBJECT OF THE AGREEMENT
The subject of this agreement is the determination of the sale, delivery, and usage conditions of the digital products and services ordered electronically by the Buyer through the website belonging to the Seller.
3. PRODUCTS AND SERVICES SUBJECT TO SALE
The products and services offered by the Seller include, but are not limited to, the following:
- MTA (Multi Theft Auto) Scripts
- Discord Bots
- Custom Software Services
- Website Services
- Digital Licenses
- Software Packages
- Server Integrations
- Technical Support Services
The type, description, price, and features of the purchased product are displayed to the Buyer at the time of order.
4. ORDER AND PAYMENT
4.1. The Buyer accepts that the information provided when creating an order is correct and complete.
4.2. The order is finalized upon the successful completion of the payment transaction.
4.3. The Seller may request additional verification in cases deemed necessary for security reasons.
4.4. The Seller is not responsible for technical disruptions arising from payment institutions or banks.
5. DELIVERY
5.1. The products sold are in the nature of digital products or digital services.
5.2. Delivery can be performed by one of the following methods:
- Access through the user panel
- Download link
- Delivery via Discord
- Delivery via email
- Sending license key or activation code
5.3. After the payment is confirmed, the product is delivered within the period specified in the product description.
5.4. In case of delays that may occur due to force majeure or technical problems, the user will be informed.
6. RIGHT OF WITHDRAWAL
6.1. Most of the products sold are in the nature of digital content and software.
6.2. In accordance with the Consumer Protection Law No. 6502 and the Distance Contracts Regulation; The right of withdrawal cannot be used in digital contents and softwares performed instantly in the electronic environment if the execution has started with the consumer's explicit consent.
6.3. The Buyer accepts that by completing the purchase process, he/she consents to the commencement of the delivery of the digital product and therefore may lose the right of withdrawal.
7. REFUND AND CANCELLATION CONDITIONS
7.1. As a rule, no refund is made for delivered digital products.
7.2. Under the following conditions, the refund request can be evaluated:
- Failure to deliver the product
- Technical error caused by the Seller
- The product does not carry the features specified in the description
7.3. Issues arising from the user's system configuration, lack of knowledge, third-party software, or server settings are not accepted as grounds for refund.
7.4. Refund requests must be sent to the destek@melonscript.com.tr address.
8. INTELLECTUAL PROPERTY RIGHTS
8.1. Intellectual property rights on all softwares, scripts, bots, designs, and contents sold belong to Melon Script.
8.2. The Buyer cannot resell the product, share the source code, copy, distribute without license, or reverse engineer.
8.3. In case of violation of these provisions, the Seller reserves the right to apply for legal and criminal remedies.
9. LIMITATION OF LIABILITY
9.1. The Seller is not responsible for indirect damages, data loss, or income loss that may arise from the use of the products.
9.2. The Seller cannot be held responsible for incompatibilities arising from MTA updates, Discord API changes, server configurations, or third-party softwares.
9.3. The Seller does not guarantee that the services will operate uninterruptedly or error-free.
10. PROTECTION OF PERSONAL DATA
Personal data belonging to the Buyer is processed and protected within the scope of the Personal Data Protection Law No. 6698 (KVKK). For detailed information, the KVKK Clarification Text and Privacy Policy can be reviewed.
11. FORCE MAJEURE
Natural disasters, war, terror events, internet infrastructure problems, power outages, cyber attacks, and similar situations are evaluated as force majeure. During force majeure, the parties cannot be held responsible for failing to fulfill their obligations.
12. RESOLUTION OF DISPUTES
The Laws of the Republic of Turkey shall apply in the implementation of this agreement. Consumer Arbitration Committees and Consumer Courts are authorized within the monetary limits declared by the Ministry of Trade for the resolution of disputes.
13. ENTRY INTO FORCE
The Buyer declares that by placing an order through the website, he/she has read, understood, and accepted the entirety of this agreement. This agreement enters into force on the date it is confirmed in the electronic environment.
